PE stamp (professional engineer seal)

A PE stamp (also called a PE seal) is the mark a licensed Professional Engineer applies to an engineering document, with their signature and state license number, certifying that they prepared or directly supervised the work and take legal responsibility for it. A US bid needs a PE stamp when the engineering deliverables will be submitted for a building permit or other government or utility approval, or are otherwise offered to the public, in which case they must be sealed by a PE licensed in the state where the project is located. Many states also apply an industrial exemption that lets a company's own employees engineer its own products and facilities without a seal, so not every engineered deliverable in a bid has to be stamped.

What is a PE stamp?

A PE stamp is the seal a licensed Professional Engineer applies, with their signature and state license number, to certify an engineering document. It tells a reviewer that a named, accountable engineer prepared or directly supervised the work and that it meets the applicable codes and standards, and it transfers professional and legal responsibility for the deliverable to that engineer. Licensure is granted state by state, not nationally: each US state and territory has its own engineering board, operating under practice acts modelled on the NCEES (National Council of Examiners for Engineering and Surveying) model law. The seal usually appears on drawings, calculations, design specifications and engineering reports, and it is the individual engineer who is licensed and accountable, not the firm.

When does a US bid need a PE stamp?

A US bid needs a PE stamp when the engineering work it commits to will produce documents that have to be sealed before they can be used. The clearest trigger is regulatory submission: plans, specifications and calculations submitted for a building permit, or for approval by a public agency, building department or utility, generally cannot advance through government review unless a licensed PE has sealed them. The broader trigger is the practice act in every state: offering engineering services to the public, or preparing engineering documents that affect public health, safety and welfare, is restricted to licensed PEs. For a bid, that means the moment your scope includes permit drawings, public-works design, or engineering issued to a client or the public, a compliant offer has to commit to sealing those deliverables and resource a licensed engineer to do it. Stamping is engineering time and legal exposure, so it belongs in the price.

Does the engineer have to be licensed in the state where the project is?

Yes. A PE stamp is only valid in the state that issued the license, so the deliverables must be sealed by an engineer licensed in the state where the project is physically located, not where your office or the engineer happens to sit. An engineer licensed in one state who wants to seal work in another must first obtain a license there, usually through comity (also called reciprocity), where the second board recognises the existing license and exam record. The industrial exemption is a provision in many states' practice acts that lets a company's own employees perform engineering on that company's own products, processes and facilities without holding a PE license or sealing the work, on the basis that the work is internal rather than offered to the public. It is what allows much engineered-to-order and manufacturing work, in sectors such as manufacturing, mining, telecommunications and oil and gas, to proceed without a stamp on every drawing. Its limits decide whether a given deliverable needs a seal, and they come down to three factors together: the state, who does the engineering, and where the document goes. In-house employees engineering the company's own product for internal use are usually exempt, no seal. The same company engaging an outside engineering consultant is generally not exempt, and the consultant must seal the work. Any design document submitted for a building permit or public-agency approval is not exempt, and a PE seal is required. The exemption also varies by state: some have narrowed it or are reviewing it, and a few do not offer it at all.
